Model Release

Please read this before you sign it. It is written to be understood.

This Performer Release and Consent Agreement is between Huge Mystery Deal Productions LLC, of 350 Ward Avenue, Suite 106-8, Honolulu, Hawaiʻi (“HMDP”), and:

referred to below as “I” or “me”. In return for one dollar and the opportunity to take part, which I acknowledge receiving, I agree to everything set out below.

Where this agreement says platform, it means any website, application or service that publishes, hosts, distributes, licenses or sells the material — including adult video sites, their related sites and subdomains, and anything that replaces them — together with the people and companies that operate them.

1. I am agreeing to be filmed and photographed

I agree to be photographed, recorded and filmed by HMDP or by anyone acting for it. I understand the material is sexually explicit, and I consent to appear fully or partly nude in it. I am doing this of my own free will. Nobody has forced, pressured or threatened me, and I am not doing it under duress.

I am of sound mind and body, I understand what this document says, and I am legally able to sign it.

2. My age, and proving it

I am at least 21 years old. I was at least 21 when the material was made.

I am giving HMDP, with this agreement:

• a clear photograph of the front of a valid government photo ID showing my date of birth, its expiry date, my photograph and my full legal name — a driving licence, passport, citizenship card, state or provincial ID, or national ID card. It does not expire within six months of today;
• a clear photograph of the back of that same ID. The back carries the signature strip, the barcode and often the address, and it is what makes an ID checkable;
• a photograph of me holding both this signed agreement and that ID, with my face clearly visible;
• a copy of an official document showing my legal name and address.

These are attached to this agreement and form part of it. I swear they were lawfully obtained by me and have not been altered in any way.

If a platform that carries the material asks to see my identification, HMDP may give them the copies I have provided. Platforms are required to check these things, and I understand that.

3. Military service

4. What HMDP may do with the material

I give HMDP all ownership rights in the material, and the absolute and irrevocable right to copyright it, use it and publish it. This permission lasts indefinitely and I cannot withdraw it.

HMDP may use, reproduce, sell, licence, rent, distribute, publish, modify, edit and alter the material. It may be used on its own or alongside other photography or film, in any medium that exists now or later, and for any lawful purpose — including trade, exhibition, illustration, promotion, publicity, advertising and electronic publication.

The material is HMDP’s property. So are all the films, recordings, reproductions, negatives, photocopies and digital copies of it.

5. Editing, and being combined with other footage

I understand and accept that the material may be blurred, distorted, altered, digitally changed, or combined with separately filmed footage of other people so that we appear together, and that I may be given a made-up name. I will not bring any claim about any of that, whether it was done deliberately or happened in the processing.

I give up any right to inspect or approve the finished material, or any wording or printed matter used with it, before it is published.

6. Where it may appear, and who may see it

HMDP may publish the material online, on any platform it chooses, including sites where people upload, publish, licence and sell adult video, and where viewers may download it. That includes those platforms’ related sites and subdomains.

I understand the material may be found by other people through those platforms, through their partners, and through ordinary search engines. If I later want it removed from search results, that is my own responsibility, not HMDP’s.

Some platforms syndicate what they carry. A platform HMDP publishes to may show the material on its own related sites, and may pass it to partner sites across a network whose members HMDP does not control and cannot list. All of that is authorised, and I am not entitled to demand that it be removed from any of it.

Separately, material published online gets copied. People download it and repost it on sites that have nothing to do with HMDP or with any platform it deals with. I understand this is a known risk of taking part, that HMDP cannot prevent it, is not responsible for it, and is under no obligation to pursue it.

The material belongs to HMDP, and so does the right to do anything about it. Only HMDP may decide whether to act against a site that has copied it. Any claim in respect of the material — including any claim of copyright, privacy or image rights — is HMDP’s to bring or not to bring. I will not bring a claim, send a notice, or demand a takedown about the material myself, and I will not hold HMDP responsible for deciding not to.

7. HMDP may pass this agreement on

HMDP may assign this agreement, and any or all of its rights under it, to anyone it chooses, at any time, in whole or in part — without asking me and without telling me. That includes assigning it to the individual people who appear in the material alongside me.

Whoever it is assigned to has exactly the same rights under this agreement as HMDP, and everything I have agreed to here applies to them in the same way and to the same extent. I may not assign this agreement or my obligations under it.

8. What I am promising

• Nobody else has an exclusive licence to my likeness, and nobody else’s permission is needed for what I am agreeing to here.
• I am responsible for what I choose to take part in, and for the risks of taking part.
• I will not take part in anything illegal, and nothing involving anyone under 18.
• I will not take part in anything that infringes someone else’s copyright, or that violates another person’s privacy or image.
• Complying with the law where I live is my responsibility.

9. Claims I am giving up

I release HMDP, and everyone acting with its permission, from any claim for libel, slander, invasion of privacy, infringement of copyright or right of publicity, or any other claim arising from the material or my part in it.

I will indemnify HMDP, and hold it and any platform harmless, against any claim, liability, cost, loss, damage or injury arising out of my participation. No warranty, representation or guarantee of any kind has been made to me, and I give up the right to bring any claim, action or proceeding against HMDP or against a platform.

10. The rest

This agreement binds my heirs and legal successors, and it benefits and may be enforced by HMDP, by any platform, and by anyone either of them passes rights to.

If any part of it is found to be invalid or unenforceable, the rest still stands.

It may be signed by email, by fax or by post, and in separate counterparts — each counts as an original, and together they form one agreement.

It is governed by the law of Hawaiʻi, and the courts of Hawaiʻi have exclusive jurisdiction over any dispute arising from it.

I have read all of it. I have had the chance to take my own legal advice before signing. It is treated as having been drafted by both of us together, so if any part of it is unclear, that unclarity will not be held against either side.

• This agreement, filled in and signed
• A photograph of you holding the signed agreement and your ID, with your face clearly visible
• A clear photograph of the front of your ID
• A clear photograph of the back of your ID

Take the ID photographs in good light, flat on a table, with the whole card in frame and every line readable. A blurred or half-cropped ID means we have to ask you to do it again.
